A new bill authored by State Rep. Guillen in the Texas House seeks to expand prosecution options for offenses involving fraudulent use or possession of credit card information, according to the Texas Legislature website.

The bill on State Finances category, introduced as HB 272 during the 89(1) legislative session on Monday, Aug. 4, was formally listed with the short title: ’Relating to creation of the Screwworm Abatement Trust (SWAT) Fund’.

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill amends the Texas Code of Criminal Procedure to address the prosecution of offenses related to the fraudulent use or possession of credit card or debit card information. It allows such offenses to be prosecuted in any county where the crime occurred or in the county where the victim resides. The bill also updates the application of trial procedures to include offenses like forgery, credit card abuse, and fraudulent use or possession of identifying information, specifically under Penal Code Section 32.315. The provisions apply only to criminal proceedings commenced on or after Sept. 1, 2025, with existing cases continuing under the previous law.

Ryan Guillen, the chair of the House Committee on Agriculture & Livestock, proposed another five bills during the 89(1) legislative session. He is also a member of the House Committee on Redistricting and a member of the House Committee on State Affairs.

Bills in Texas go through a multi-step legislative process, including committee review, debates, and votes in both chambers before reaching a final decision. Each session, there are typically thousands of bills introduced, but only a portion successfully navigate the process to become law.
